These Terms and Conditions ("Terms") govern your access to and use of the ESEN Analytics Systems LLC platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use.

1. Nature of the Service

ESEN Analytics Systems LLC provides a cloud-based Software-as-a-Service (SaaS) platform offering portfolio analytics, data visualization, systematic allocation frameworks, and monitoring tools. The Service is software-based and strictly informational in nature.

2. No Investment Advice

The Service does not provide investment advice, personalized recommendations, financial planning, brokerage services, or trade execution. All information is provided for educational and analytical purposes only. Users are solely responsible for their own financial decisions and should consult with a qualified professional before making any investment.

3. No Custody of Funds

ESEN Analytics Systems LLC does not hold, receive, control, or manage client funds. We are a technology provider. Any connections to third-party brokerage platforms (such as Interactive Brokers), if enabled by the user, remain fully under the user's independent control and responsibility.

4. Subscriptions & Billing

Access to the Service is provided on a subscription basis. Subscriptions are billed in advance via our third-party payment processor (Stripe). Subscriptions may be canceled at any time. Cancellation stops future billing but does not retroactively refund previously billed periods.

5. Intellectual Property

All software, proprietary models, analytics, visualizations, and content provided through the Service are the intellectual property of ESEN Analytics Systems LLC. Unauthorized copying, reverse engineering, or redistribution is strictly prohibited.

6. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. ESEN Analytics Systems LLC shall not be liable for any financial losses, market outcomes, data inaccuracies, or third-party service interruptions. Use of the Service is entirely at the user's own risk.

7. No Guarantees

Past performance or historical data displayed on the Service does not guarantee future results. No guarantees are made regarding the performance, profitability, or specific risk levels of any analytical model.

8. Modifications

We reserve the right to update or modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
